TERMS OF USE

These Terms of Use govern access to and use of the Medical Health Covers Inc. (“MHC,” “we,” “our,” or “us”) platform, website, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not use the Platform.

Platform Services; No Practice of Medicine

Medical Health Covers Inc. (“MHC”) operates solely as a technology and administrative platform that facilitates communication and coordination between participating clinics and independently licensed healthcare providers who may perform Good Faith Examinations or other medical evaluations.

MHC does not provide medical services and does not practice medicine or any other licensed healthcare profession.

All healthcare services are provided exclusively by licensed healthcare professionals who are independent of MHC and who exercise their own independent medical judgment in the evaluation, diagnosis, and treatment of patients. MHC does not control, direct, or influence the clinical decision-making of any healthcare provider.

MHC does not diagnose medical conditions, provide medical advice, recommend treatment plans, prescribe medications, or determine whether any patient should receive medical treatment or prescription therapy.

Any medical information made available through the Platform is provided by healthcare professionals or clinics and is not intended to replace the independent judgment of a licensed healthcare provider.

The use of the Platform does not create a physician-patient relationship between MHC and any patient. Any physician-patient relationship that may arise exists solely between the patient and the evaluating healthcare provider or treating clinic.

Independent Healthcare Providers

Healthcare providers who utilize the Platform are independent professionals or entities that are solely responsible for the medical services they provide. Such providers are not employees, agents, partners, or representatives of MHC.

Each healthcare provider retains full authority and responsibility for the provision of healthcare services, including but not limited to determining whether a patient is an appropriate candidate for a requested treatment or prescription, establishing treatment plans, issuing prescriptions, and complying with all applicable federal and state laws governing medical practice, telehealth services, and patient care.

MHC does not supervise, direct, or control the clinical activities of healthcare providers and does not require providers to approve or deny any particular treatment, procedure, or prescription.

Healthcare providers are solely responsible for their professional judgment, regulatory compliance, and patient care.

To the extent clinics, pharmacies, or other healthcare entities utilize evaluations performed through the Platform, those entities remain independently responsible for their own medical decisions, regulatory compliance, and patient care obligations.

No Guarantee of Medical Clearance

Use of the Platform does not guarantee that a patient will be approved, cleared, or deemed eligible for any medical treatment, prescription, or procedure.

Healthcare providers performing Good Faith Examinations or other medical evaluations may determine, in their sole professional judgment, that a patient is not an appropriate candidate for treatment or that additional medical evaluation is required.

MHC does not influence or control these determinations and makes no representations or guarantees regarding the outcome of any medical evaluation.

No Responsibility for Treatment Provided by Clinics

Any medical procedures, treatments, prescriptions, or services that may occur after a Good Faith Examination are performed solely by the treating clinic or healthcare provider responsible for that care.

MHC does not participate in the provision of treatment, does not supervise clinical procedures, and is not responsible for the quality, safety, or outcome of any treatment or service provided by clinics, healthcare providers, or pharmacies that may rely on evaluations performed through the Platform.

Administrative and Technology Fees

Fees associated with the use of the Platform represent administrative and technology service fees for access to the Platform and related coordination services.

Such fees are not payments for medical services.

Healthcare providers independently determine whether to utilize the Platform and may separately establish their own professional fees for medical services in accordance with applicable laws and regulations.

User Responsibilities and Accuracy of Information

Users are responsible for providing complete, accurate, and truthful medical and personal information when using the Platform.

Healthcare providers rely on the information submitted through the Platform when performing evaluations. Providing inaccurate, incomplete, or misleading information may affect the provider’s ability to conduct an appropriate medical assessment.

MHC is not responsible for any outcomes resulting from inaccurate or incomplete information provided by users.

No Emergency Services

The Platform is not intended for use in medical emergencies or urgent medical situations.

If you are experiencing a medical emergency, call 911 or seek immediate medical attention immediately.

Eligibility

The Platform is intended only for individuals who are at least eighteen (18) years of age or the legal age of medical consent in the applicable jurisdiction.

By using the Platform, you represent and warrant that you meet these eligibility requirements.

Platform Availability

MHC makes reasonable efforts to maintain the availability and functionality of the Platform but does not guarantee uninterrupted or error-free operation.

The Platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond MHC’s control.

Limitation of Liability

To the fullest extent permitted by applicable law, MHC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to:

  • the use of the Platform
  • any medical evaluation performed by a healthcare provider
  • any treatment provided by a clinic or healthcare professional
  • reliance on information submitted by users

MHC’s total liability for any claim arising out of the use of the Platform shall not exceed the amount paid, if any, for access to the Platform.

Privacy

Use of the Platform is also governed by our Privacy Policy, which describes how personal information may be collected, used, and protected.

Changes to Terms

MHC reserves the right to modify or update these Terms of Use at any time. Updated versions will be posted on the Platform with a revised effective date.

Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law principles.
